These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and the operator of Helpful-Writing.com (the “Platform” or the “Service”) governing your access to and use of all features, content, and services made available through the Platform. By accessing, browsing, or otherwise using the Service in any capacity, you acknowledge that you have read, understood, and agreed to be bound by these Terms and by our Privacy and Cookies Policy. If you do not agree to these Terms, you must discontinue all use of the Platform immediately.

1. Acceptance of Terms and Proper Use

By using the Platform, you acknowledge that you agree to these Terms and the Privacy and Cookies Policy. You must use the Platform only for lawful, personal, and legitimate purposes and refrain from conduct that is harmful, deceptive, or unlawful under any applicable jurisdiction.

You agree to exercise sound judgment when interacting with the Platform or Specialists and not to disclose personal or third-party information unless it is strictly necessary for receiving the Services and does not conflict with these Terms.

2. Description of Services

2.1. Nature of the Service

The Platform operates as an online environment that allows Users to connect with independent Specialists who offer advisory, explanatory, and educational guidance across various subjects. The Platform itself does not provide these advisory services and does not act as a Specialist.

Users describe the task for which they seek assistance, including any relevant details, and the Platform facilitates a match with a Specialist. The Platform does not guarantee availability, suitability, or performance of any particular Specialist.

2.2. Relationship Between Users and Specialists

Specialists operate independently and determine how they will deliver their guidance. They are not employees, contractors, or representatives of the Platform. Users must rely on their own judgment when engaging with a Specialist and accept full responsibility for choosing to proceed.

2.3. Advisory Nature of Services

The Services consist solely of ethical learning guidance. Specialists may help Users understand concepts, develop approaches, or improve skills, but they do not produce academic submissions on a User’s behalf. The Platform prohibits any use of the Services for cheating, misrepresentation, or academic dishonesty.

3. User Obligations

  • Users must provide accurate information when requesting guidance or describing a task.
  • Users are responsible for maintaining the confidentiality of their submitted data.
  • Users must not attempt to bypass the Platform by engaging Specialists outside the Platform for communication or payment.

4. Restrictions on Use

You may use the Platform only in compliance with applicable law. Prohibited use includes:

  • Violating any federal, state, local, or international law or regulation.
  • Sending unsolicited promotional content or similar communications.
  • Impersonating the Platform, its employees, another User, or any third party.
  • Interfering with others’ use of the Platform or exposing the Platform or Users to liability.
  • Using automated tools to access, monitor, or copy Platform content without permission.
  • Disabling, disrupting, or interfering with the operation of the Platform.
  • Uploading or introducing malicious code or harmful technological components.
  • Attempting to gain unauthorized access to Platform systems, servers, or related databases.
  • Carrying out denial-of-service or similar attacks.
  • Engaging in any behavior intended to interfere with proper Platform functionality.

5. Data Usage

The Platform uses personal information to operate, maintain, and improve the Service, including:

  • Enhancing website and application functionality;
  • Processing transactions and facilitating communication with Specialists;
  • Developing new features and improvements;
  • Monitoring Platform usage to optimize efficiency;
  • Detecting and addressing fraudulent or prohibited activities;
  • Enforcing these Terms and related policies;
  • Protecting the rights and safety of Users and the Platform;
  • Conducting analytics, reporting, and administrative operations.

6. Payment and Billing Policies

Users agree to pay the fees displayed at the time of engaging a Specialist. Service costs are determined based on project type, complexity, and urgency. A 11% service fee is included in the price.

6.1. Transparent Pricing

The pricing is transparent, with no hidden charges. Any adjustments will be confirmed before additional fees are applied. Where required by law, applicable taxes may be included in the total amount charged.

6.2. Payment Methods

The Platform accepts secure payments via major credit/debit cards, PayPal, Apple Pay, and Google Pay. All charges are displayed in U.S. dollars. Payment must be completed before any service is initiated. The Platform facilitates the transaction but does not control the quality or suitability of advisory Services provided by Specialists. The Platform is not responsible for, and prohibits, any payments or financial arrangements made outside the Platform.

6.3. Invoices and Confirmation

Upon successful payment, User will receive a receipt and invoice via email. Institutional clients may request customized invoices for reimbursement or accounting needs.

7. Refund Policy

Refunds may be considered when you believe the Services provided fall below the standards outlined in these Terms or materially deviate from what was agreed upon at the outset of the engagement. All refund determinations are made at our sole discretion based on an assessment of whether the issue arises from our service delivery.

7.1. Refund Eligibility and General Conditions

Refund requests may be considered under circumstances such as:

  • A billing error resulting in duplicate payment. The additional payment will be refunded once confirmed.
  • You cancel the Service after payment. During this period, only partial refunds may be available, reflecting the work already initiated.
  • A significant failure to deliver guidance or advice in accordance with the agreed-upon parameters.

Refund requests will be denied when:

  • You provide no specific explanation of the issue.
  • The outcome was affected by missing, unclear, or incomplete instructions.
  • The deadline or scope could not be met because you did not supply necessary information.
  • You approved the Service outcome.
  • The claim is submitted outside the designated timeframe.
  • There are indications of attempts to engage in prohibited direct communication outside the Platform.

The final refund amount is determined after an internal evaluation.

7.2. Submitting a Request

Send all refund requests to [email protected]. Include:

  • Your full name
  • The service reference number
  • A clear description of the issue
  • Any relevant supporting evidence (screenshots, files, etc.)

All refund requests are reviewed within 10 business days.

7.3. Deadlines for Refund Requests

Refund claims must be submitted within 10 business days after the completion of the Service. Claims submitted after this window will not be processed.

7.4. Evaluation Process

Refund eligibility depends on whether the issue arises from our provision of the Services. Requests will be denied if:

  • Incomplete or unclear instructions were provided.
  • The outcome was explicitly approved.
  • The claim was submitted after the designated period.

Approved refunds are processed to the original payment method within up to 10 business days, subject to payment-provider timelines.

7.5. Escalations

If you disagree with a refund decision, reply to our response with “Escalation Request” in the subject line. Your case will undergo an additional review.

8. Intellectual Property

All Platform content—including text, graphics, software, and design—is owned by or licensed to the Platform. Users may not copy, distribute, modify, or create derivative works without prior written permission.

9. Limitation of Liability

9.1. Exclusion of Certain Damages

To the fullest extent allowed by law, the Platform is not liable for indirect, incidental, special, consequential, or similar damages, including loss of data, revenue, profits, contracts, or goodwill, arising from or related to your use of the Platform.

9.2. Aggregate Liability Cap

Except where prohibited by law, the maximum total liability of the Platform for any claim related to your use of the Service will not exceed the amount you paid to the Platform (excluding amounts paid to Specialists) in the twelve (12) months prior to the incident giving rise to the claim.

9.3. No Liability for Third-Party Conduct

The Platform is not responsible for any damages arising from conduct by Users or Specialists, including misconduct, fraud, or any offline or online interactions.

If you have a dispute with a Specialist, you release the Platform from all related claims.

10. Geographic Restrictions

The Platform is operated from the United States. Access may be restricted or unlawful in certain jurisdictions. Users accessing the Platform from outside the United States do so at their own initiative and remain responsible for complying with local laws.

11. Dispute Resolution

11.1. Arbitration Agreement

Any claim or dispute arising from these Terms or the use of the Platform that cannot be resolved informally or in small claims court must be resolved through binding individual arbitration. This requirement applies to the Platform and to all affiliated parties.

11.2. Notice and Informal Resolution

Before initiating arbitration, the complaining party must send a written Notice of Dispute describing the issue and requested remedy to [email protected]. If the dispute is not resolved within thirty (30) days, either party may commence arbitration.

12. Termination

The Platform may suspend or terminate User access at its discretion for violations of these Terms or for conduct that the Platform deems harmful to its operations or its Users.

13. Changes to Terms

The Platform may update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.
